Technology Services Guarantee

30-Day Limited Guarantee for Eligible Services Provided by Upper Valley Advance, LLC

Upper Valley Advance, LLC ("Upper Valley Advance," "we," "us," or "our") provides the following 30-day limited guarantee to the customer identified on the applicable Service Order ("Client," "you," or "your"). This Guarantee applies only to eligible labor performed directly by Upper Valley Advance.

1. Eligible Services

1.1 The Guarantee applies to labor that the Client paid Upper Valley Advance to perform under a Service Order, unless the Service Order expressly identifies a different written guarantee or states that the labor is not eligible.

1.2 A free consultation or Free Device Assessment is not a promise that a device is repairable or that every condition will be identified. A paid diagnostic service is guaranteed only to be performed using professional and reasonable methods appropriate to the information and condition reasonably available at the time.

1.3 Parts, hardware, software, licenses, subscriptions, third-party services, shipping, travel, mileage, and on-site fees are not covered by this labor Guarantee.

2. Guarantee Period

2.1 The 30-day guarantee period begins on the completion date shown on the Service Order or invoice. If no date is shown, it begins when the device is returned or made available for return, or when the remote or on-site session concludes.

2.2 The Client must notify Upper Valley Advance of the claimed issue within the 30-day period and provide a reasonable opportunity to inspect, reproduce, and correct the issue.

2.3 Follow-up communication, inspection, or corrective work does not restart or extend the original 30-day period. New paid work documented on a separate Service Order may have its own guarantee period.

3. Covered Workmanship and Remedy

3.1 The Guarantee covers a reproducible problem directly caused by Upper Valley Advance's workmanship in performing the specific authorized labor.

3.2 For an approved claim, the exclusive guarantee remedy is corrective labor reasonably necessary to address the qualifying workmanship issue, provided without an additional labor charge.

3.3 Upper Valley Advance may choose to provide a service credit or refund of the labor charge for the qualifying service instead of corrective labor. This optional alternative does not increase the Guarantee's scope or value.

3.4 The total value of corrective labor, credit, or refund under this Guarantee will not exceed the amount the Client paid Upper Valley Advance for the qualifying labor.

4. Exclusions

4.1 The Guarantee does not cover a pre-existing, latent, intermittent, unrelated, or newly occurring condition; ordinary wear; accidental or liquid damage; malware or reinfection; data loss; corrupted data or software; Client misuse or neglect; environmental conditions; power or network events; or inaccurate or incomplete information supplied to us.

4.2 The Guarantee does not cover a failure, incompatibility, update, defect, policy, outage, or action of a manufacturer, vendor, carrier, account provider, operating system, software provider, or other third party.

4.3 The Guarantee does not cover work, modification, repair, configuration, installation, or interference by the Client or another person after completion when it caused or materially contributed to the issue.

4.4 The Guarantee does not promise recovery of data, uninterrupted or error-free operation, prevention of future malware or failure, identification of every hidden or intermittent issue, or a result outside the original authorized scope.

5. Claim Process

5.1 To make a claim, contact Upper Valley Advance within the guarantee period and identify the Service Order or invoice, device, original service, and current symptoms.

5.2 The Client must provide reasonable access to the device, system, account, location, and information needed to evaluate the claim. If the issue cannot be reproduced or access is not provided, we may be unable to approve or complete corrective work.

5.3 Do not authorize another provider to perform corrective work for the claimed issue before giving Upper Valley Advance a reasonable opportunity to inspect and correct it, unless immediate action is reasonably necessary to prevent personal injury or material property damage.

6. Parts and Third-Party Warranties

6.1 Parts, hardware, software, and third-party products remain subject to their manufacturer's or vendor's warranty and return terms.

6.2 Unless the Service Order expressly states otherwise, labor, shipping, removal, reinstallation, data transfer, and configuration associated with a third-party warranty or replacement are not included in this Guarantee and may be separately charged.

7. Limitation and Nonwaivable Rights

7.1 To the maximum extent permitted by law, Upper Valley Advance is not liable under this Guarantee for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost data, revenue, profits, business, opportunity, use, or productivity.

7.2 This Guarantee does not exclude liability or remedies that cannot lawfully be limited or waived and does not attempt to waive rights under New Hampshire RSA 358-A or another applicable consumer-protection law.

8. Relationship to Other Documents

8.1 This Guarantee exclusively controls whether a claim qualifies for the 30-day limited guarantee and what remedy is available. The Technology Services Agreement continues to control the underlying service, authorization, payment, and service-related liability.

8.2 If two documents directly conflict, they control only within their assigned subject matter: a Service Order controls the expressly stated scope, price, and service-specific terms; the Technology Services Agreement controls performance of technology services, authorization, payment, and service-related liability; the Technology Services Guarantee controls eligibility, claims, and remedies under the 30-day limited guarantee; the Coupon Use and Exclusions Policy controls promotional coupons; the Privacy Policy controls collection, use, retention, and disclosure of personal information; and the Terms of Service govern general website use and any matter not addressed by a more specific document. A Service Order overrides another document only when it expressly identifies the provision being changed. Rights or obligations that cannot lawfully be waived remain controlling.
